Résumé

In the judgment "Google Ireland Limited" (case C-376/22), the Court of Justice interprets the country-of-origin principle of the E-Commerce Directive in the context of a national legislation of a Member State providing for obligations on online platforms established in another Member State to monitor and notify illegal content online. The Court held that the obligations in question did not fall within the derogating regime of the country-of-origin principle, which applies only to targeted regulatory intervention on a case-by-case basis in order to protect one of the general interest grounds set out in the Directive. As a result, the principle of moderation of content in the platforms’ State of origin prevails, blocking any attempt at systematic regulation by the Member States in which the digital services are used. This judgment is disappointing because it is based on the narrative of “decreed” mutual trust within the internal market without addressing the new challenges of the digital public space. Admittedly, the Court probably had little room for interpretation with regard to the relevant provisions of the E-commerce Directive. Nevertheless, its analysis is questionable at a time when the European Union is striving to establish digital trust, notably through the Digital Services Act (DSA), which recently came into force. Against this background, this contribution proposes a number of avenues for initiating a constructive dialogue of interpretative sources between the E-commerce Directive and the DSA.
